The damages claimed by Infinity Ward developers Jason West and Vince Zampella against Activision have grown to over $1billion, according to the publisher’s quarterly SEC filing.
The two sued Activision for $36 million after the two were dismissed from the company for "breaches of contract and insubordination" on March 1, 2010.
The pair filed suit on March 3, and Activision filed a counter-suit on April 9, 2010, alleging the pair had been in contact with EA, and violating the terms of their contract.
EA was added as a defendant in the countersuit on January 18 of 2011, but the case was resolved in a surprise settlement announced today by the two companies.
The Activision Q4 SEC filing claims the damages sought by West-Zampella grew during disovery to exceed a billion dollars, in addition to declamatory relief.
The trial of the case will begin on May 29th, after Activision’s request for a thirty day extension be granted to allow Beth Wilkinson, the recently appointed head attorney for the company’s claim, to prepare.
